A legal disclaimer

1. Scope of Services Utah At Home Care, LLC is a non-medical home care provider. We provide assistance with Activities of Daily Living (ADLs) and Instrumental Activities of Daily Living (IADLs) as defined by Utah Administrative Rule R432-725.
 

2. No Professional Clinical Liability Utah At Home Care, LLC is not a medical provider, home health agency, or hospice provider.
 

  • Our staff does not provide skilled nursing care, medical diagnosis, or clinical treatment.
  • We do not assume professional clinical liability for medical outcomes. 
  • If a client's needs evolve to require clinical intervention, we will facilitate a referral to a licensed medical partner, but the transition of care remains the responsibility of the client and their legal representatives.
     

3. Limitation of Liability The information provided on www.utahathomecare.com is for general informational purposes only. While we strive for "High-Reliability" in our non-medical care, we are not liable for any medical emergencies or clinical issues that fall outside the scope of non-medical personal care services.
 

4. External Links & Portals Our website contains links to a secure external portal. While we utilize high-standard, HIPAA-secure software for client management, Utah At Home Care, LLC is not responsible for technical interruptions or the privacy practices of third-party software providers beyond our contractual agreements.

Disclaimer: Non-Medical Status

Important Notice: Utah At Home Care, LLC provides non-medical home care services. Our services are designed to support independence through personal care and companionship. We do not provide clinical medical advice, and our "Professional Oversight" refers to the supervision of personal care aides in a non-clinical capacity. For medical emergencies, always dial 911.

Service Limitation Clause

Caregivers are strictly prohibited from performing 'skilled nursing tasks', including, but not limited to, wound care, catheter management, or administering injections and medications. Any request for such services must be directed to a licensed Home Health Agency.

Mandatory Reporting Disclosure (R432-725-6.4)

We reserve the right to disclose personal information as required by Utah law, specifically in compliance with mandatory reporting requirements for suspected abuse, neglect, or exploitation of vulnerable adults. In Utah, anyone who has reason to believe that a vulnerable adult has been the subject of abuse, neglect, or exploitation is a Mandatory Reporter under Utah Code § 76-5-111.1. In accordance with Utah state law, Utah At Home Care, LLC is a mandatory reporter. We are legally required to report any suspected abuse, neglect, or exploitation of a vulnerable adult to the appropriate state authorities. Clients have the right to be free of mental abuse, physical abuse, and exploitation. Our staff is trained annually on Utah's mandatory reporting requirements.

Referral Requirements Disclaimer (R432-725-9.2)

In accordance with Utah R432-725-9, if a client’s needs exceed the scope of personal care, we will facilitate a referral to a licensed health care professional or appropriate alternative service. Referrals to third-party medical providers or home health agencies are provided as a convenience. Utah At Home Care, LLC does not receive referral fees and is not responsible for the quality of care provided by external partners.

Clients have the right to be treated with respect and dignity, to be free from mental and physical abuse, and to be fully informed of all services and related charges prior to the commencement of care.
